I’ve know Adam for a couple of years, personally, as we worked out together at the same CrossFit gym. He’s one hell of a guy, has a beautiful family and amazing work ethic in the gym, in life, and in the office. I recently got myself into a sticky situation with a Super Speeder citation issued by GSP in Oconee County. Reaching out to Adam was my first thought. He quickly put my mind at ease with how much he was able to offer me concerning his knowledge of Oconee County’s court system, specifically. He was with me throughout the entire 4(ish) month long timeframe that it took to resolve the citation. Being a former Firefighter, it was important for me to maintain my Class F driver’s license for potential future employment with public services and he was able to assist me in a plea that allowed for just a couple points on my license and a fine. The judge was made confident by Adam’s and my presence in court that I had learned a valuable lesson about the dangers of speeding, especially as a public servant who has personally seen outcomes worse than simply a citation for speeding. My gf and I are so very grateful for the friendship we have with Adam and his family if not just for this occurrence! I highly, highly, highly recommend Adam and his practice for anything law related, especially if in Oconee County!! 10/5 stars across the board, sincerely!

Why Should You Consider Hiring a Criminal Defense Lawyer?

Being accused of a crime can be terrifying. As the severity of the charges grows, so does the possibility of paying high fines and spending time in jail or even prison. Since the stakes are high, it’s not the time to make the wrong decisions and try to fight the charges by yourself.

However, hiring a good criminal defense attorney can be beneficial to your case. They can guide you through the complex criminal justice system and make sure your rights are protected.

If you are facing a criminal charge for serious traffic offenses, violent crimes, or some other criminal offense, retaining the legal services of an Athens criminal defense attorney is highly recommended.

How Does a Criminal Case Work?

The criminal process in Georgia can be hard to understand. For example, since multiple Georgia courts can have jurisdiction over certain criminal cases, which court would handle a particular case depends on the nature of the charges and whether the charge is a misdemeanor or felony.

Generally, the criminal process includes everything that happens from the time a person is suspected of committing a crime through the prosecution and even after the case is over. A criminal case in Athens, Georgia, proceeds through the stages such as arrest, first appearance, preliminary hearing, Grand jury review, arraignment, trial, sentencing, and appeals. Of course, the exact process depends on the category of the offense and the nature of the charges.

As soon as someone is arrested, the law enforcement officer must tell them they have the right to remain silent and to be represented by criminal defense attorneys. These rights are referred to as Miranda rights. Even if you are innocent or believe you haven’t done anything wrong, it’s always wise to seek advice from criminal defense lawyers before talking to the police.

Being charged with committing a criminal offense should not be taken lightly. Your future is on the line, so having an experienced criminal law lawyer in Athens, Georgia, on your side can be a smart move.

Client Victories

No matter the charge, know that you are not alone. Read about clients with similar charges who were able to achieve victory at trial or on appeal.

FELONY FORGERY

Not Guilty on All Counts

The client was charged with cashing fraudulent checks. Ryan proved to the jury that his client was actually an unwitting accomplice in an international fraudulent check scam. The accused was the victim. The jury declared his client not guilty on all counts.

CHILD MOLESTATION CHARGES

Charges Dismissed

The client was charged with child molestation. After an aggressive, early investigation, Adam successfully got the charges dismissed before the case was indicted.

POLICE OFFICER ASSAULT

Not Guilty on All Charges

The client was accused of assaulting a police officer. Ryan convinced the judge to release her on bond before trial, and despite video evidence, the jury sided with the accused. It found her not guilty on all charges. She left the courtroom a free woman.

FRAUD CHARGES

Case Dismissed

The client faced fraud charges for allegedly stealing more than $20,000.00. After Adam filed and won a plea in bar and a special demurrer, the client’s felony case was dismissed.

TRAFFICKING

All Charges Were Dismissed

Client faced decades in prison after receiving 50 pounds of marijuana in the mail. Through a pretrial motion to suppress evidence, Ryan successfully argued that the search warrant was fatally flawed. The trial court excluded all evidence against his client, and all charges were dismissed.

DRUG TRAFFICKING

Motion to Suppress Granted

Client was charged with trafficking in methamphetamine. After a motion to suppress and legal argument, the trial court granted Adam’s motion to suppress, preventing the state from using any of the alleged contraband at trial and resulting in a dismissal of the case.

Frequently Asked Questions

1. What should I do first if I'm charged with a crime in Athens, Georgia?
As soon as possible, you should contact a criminal defense attorney. Avoid speaking freely with law enforcement without representation, exercise your right to remain silent, and ask for your lawyer. Your attorney can advise you on whether to post bond, seek pre-trial release, and begin preparing your defense (for example, by gathering evidence, locating witnesses, and reviewing police reports).
2. What kinds of criminal charges does Swingle Levin LLC handle?
They handle a wide range of criminal charges ranging from misdemeanors to serious felonies. Examples include theft, assault and battery, DUI, drug crimes, computer crimes, fraud, sex offenses, murder, burglary, and traffic offenses like reckless driving. They also handle aggravated or complex cases and take on serious charges like those that may carry life in prison or death penalty exposure.
3. What is involved in a criminal case in Georgia?
In Georgia, a criminal case typically proceeds through these stages: arrest, first appearance, possibly preliminary hearing (if felony), arraignment, plea negotiations or pre-trial motions, trial, sentencing if convicted, and then appeals if there are legal grounds. The exact path depends on the severity of the charge, whether it’s a felony or misdemeanor, and whether key issues (like evidence admissibility or constitutional violations) arise.
4. Can charges be dismissed before trial?
Yes. There are opportunities for dismissal before trial, for instance when motions to suppress evidence are successful (arguing that improperly obtained evidence should be excluded), when the prosecution lacks sufficient evidence, or when procedural or constitutional rights have been violated. A strong defense attorney can explore these options early in the case.
5. What are my rights and what risks should I be aware of when facing criminal charges?
You have rights including the right to remain silent, the right to an attorney, the right to a fair trial, and the right to challenge the evidence against you. Risks include conviction, mandatory minimum sentences, high fines, long jail or prison time, collateral consequences (like probation, loss of driving privileges, or immigration impacts), and damage to reputation. Working with an attorney who knows Georgia criminal law—including pre-trial and trial strategy—helps ensure your rights are protected and your risks minimized.
