I’ve know Adam for a couple of years, personally, as we worked out together at the same CrossFit gym. He’s one hell of a guy, has a beautiful family and amazing work ethic in the gym, in life, and in the office. I recently got myself into a sticky situation with a Super Speeder citation issued by GSP in Oconee County. Reaching out to Adam was my first thought. He quickly put my mind at ease with how much he was able to offer me concerning his knowledge of Oconee County’s court system, specifically. He was with me throughout the entire 4(ish) month long timeframe that it took to resolve the citation. Being a former Firefighter, it was important for me to maintain my Class F driver’s license for potential future employment with public services and he was able to assist me in a plea that allowed for just a couple points on my license and a fine. The judge was made confident by Adam’s and my presence in court that I had learned a valuable lesson about the dangers of speeding, especially as a public servant who has personally seen outcomes worse than simply a citation for speeding. My gf and I are so very grateful for the friendship we have with Adam and his family if not just for this occurrence! I highly, highly, highly recommend Adam and his practice for anything law related, especially if in Oconee County!! 10/5 stars across the board, sincerely!

The Importance of Hiring a Skilled Georgia Criminal Defense Attorney for Child Pornography Cases

If you are under investigation or have been charged with a child pornography offense in Georgia, you could be facing severe criminal penalties, including prison time and mandatory sex offender registration. These cases often involve digital evidence, search warrants, and the seizure of personal devices.

However, an experienced Georgia criminal defense attorney can review the evidence, explain the charges, and guide you through each stage of the legal process.

At Swingle Levin LLC, we provide confidential and strategic defense for individuals accused of child pornography offenses in Georgia. Our team understands these cases’ emotional and legal complexity. Additionally, we work tirelessly to protect your rights, examine the evidence, and fight for a favorable result.

What Constitutes Child Pornography Under Georgia Law?

Georgia specifically defines and punishes child pornography through OCGA § 16-12-100, which sets comprehensive rules against sexual exploitation of minors.

The law classifies “child pornography” broadly. It includes any visual depiction, such as photos, videos, digital images, or computer-generated material, showing a minor (under 18) engaged in sexually explicit conduct. Sexually explicit conduct covers:

  • Sexual intercourse: genital, oral, or anal
  • Bestiality
  • Masturbation
  • Lewd exhibition of genitals
  • Sadistic or masochistic abuse

Several types of charges are associated with these laws:

  • Possession: Having child pornography on any device is a felony. Each image or video can result in separate charges.
  • Distribution/Production: Sharing, selling, or creating illegal material has harsher penalties, especially if minors are exploited directly.
  • Internet-Based Offenses: Many charges arise from file-sharing platforms, cloud storage, social media, or peer-to-peer networks.
  • Sexting Among Minors: Even consensual sharing of sexually explicit images between teenagers can result in child pornography charges under Georgia law.

Intent and knowledge are pivotal elements under Georgia law. Prosecutors are required to prove you knowingly possessed, distributed, or created this material.

We can scrutinize scenarios such as:

  • Accidental downloads as part of larger file collections
  • Receiving unsolicited content through texts or apps
  • Media stored in device caches you do not control or know about
  • Inheritance of devices previously owned by someone else
  • Shared computers used by multiple people

Our team focuses on uncovering evidence that supports your defense and challenges the prosecution’s assumptions.

Potential Penalties for Child Pornography in Georgia

At Swingle Levin LLC, we believe every client should fully understand the consequences associated with these serious charges. A conviction can change every aspect of your life, even for a first offense.

  • First Offense:
    • 5 to 20 years in prison, minimum (the exact sentencing varies depending if you’re charged with possession, distribution or production, plus the number of images or videos involved, etc.)
    • Mandatory sex offender registration
    • Probation and supervised release
  • Subsequent Offenses:
    • Possible life imprisonment
    • Heightened supervision and monitoring
    • Increased fines and additional penalties
  • Financial and Professional Consequences:
    • Substantial fines, often totaling thousands of dollars
    • Risk of losing parental rights
    • Revocation of professional licenses (for teachers, healthcare workers, etc.)
    • Forfeiture of assets tied to the alleged crime
  • Long-Term and Lifetime Consequences:
    • Severe employment, housing, and education barriers
    • Prohibitions on residing near schools, parks, or playgrounds as part of Georgia’s State Sexual Offender Registry
    • Indelible digital footprint and public record of your conviction

How a Georgia Criminal Lawyer Can Defend You: What the Process Looks Like

Defending against child pornography charges requires more than legal knowledge; it demands a strategic, case-specific approach that protects your rights and challenges the prosecution’s evidence at every turn. We can assess every angle of the case to seek a favorable outcome.

Here’s what you can expect when facing child pornography charges in Georgia:

  • Challenging Illegal Searches and Seizures: Law enforcement is required to follow strict procedures when collecting digital evidence. If devices were searched or seized without a valid warrant or proper legal authority, we can move to suppress that evidence and weaken the case.
  • Disputing Ownership, Intent, and Access: In many cases, factors such as shared computers, accidental downloads, or malware infections can complicate intent determination. We are ready to explore whether you knowingly accessed or possessed illegal content, or whether your access was unintentional or mistaken.
  • Analyzing Legal Definitions and Digital Evidence: We often scrutinize whether the materials in question meet the legal definition of child pornography. This may involve verifying ages, reviewing metadata, or identifying if the content was artificially created. Digital forensics professionals can help uncover timelines, device history, and file behavior that may support the defense.
  • Protecting Privacy and Public Reputation: Maintaining privacy is essential in sensitive cases like these. We can take steps to minimize media exposure, limit the release of personal information, and protect the client’s reputation throughout the legal process.

Early legal intervention is critical. When we’re involved from the start, we can help preserve key evidence, initiate dialogue with investigators, and sometimes prevent charges from being filed altogether.

1) What does Georgia law consider “child pornography” (sexual exploitation of children)?
Georgia’s primary child pornography statute is commonly referred to as the “sexual exploitation of children” law. It defines key terms such as “minor” (generally under 18) and “sexually explicit conduct,” and it can apply to visual depictions, including digital images and videos, that meet the statute’s definitions.
2) What charges can be filed in a Georgia child pornography case?
Charges can vary depending on the alleged conduct and how the material was handled. Common charge categories can include allegations related to possession, creation/production, or distribution of prohibited material. The specific charges and potential penalties depend on the statute section charged and the facts alleged in the case.
3) Can someone face both Georgia and federal charges for the same situation?
Yes. Some cases may involve state charges, federal charges, or both—especially when allegations involve internet activity or conduct that crosses state lines. Federal child pornography statutes can apply in certain circumstances, and federal and state investigations may overlap.
4) What usually happens early in the legal process, and what rights are involved?
These cases often begin with an investigation that may involve search warrants, seizure of electronic devices, and digital forensic review of phones, computers, accounts, or storage media. Early court steps can include an initial appearance, formal charging, and—depending on the court—bond/bail determinations. Constitutional rights that commonly arise include protections related to search and seizure and the right to counsel.
5) Does a conviction require sex offender registration in Georgia, and can registration ever end?
For certain convictions, Georgia law may require sex offender registration. Whether registration applies depends on the offense of conviction and how Georgia classifies it. In some situations, Georgia law allows a person to petition a court for relief from registration requirements, but eligibility is limited and depends on specific statutory criteria.
